Dossier of request for application of bilateral safeguard measures when implementing UKVFTA

According to Circular 14/2021/TT-BCT, dossiers of request for application of bilateral safeguard measures when implementing the UKVFTA Agreement include:- Application for application of a bilateral safeguard measure- Relevant papers and documents as prescribed in Article 47 of Decree 10/2018/ND-CP.

In particular, a request for application of bilateral safeguard measures as prescribed in Clause 2, Article 47 of Decree 10/2018/ND-CP must satisfy the following specific details:
(1) Name, address, and other necessary information of the organization or individual representing the domestic industry;
(2) Information, data, and evidence to identify the representative of the domestic manufacturing industry, including a list of domestic organizations and individuals producing similar or directly competitive goods; volume and quantity of similar or directly competitive goods produced by the above-mentioned organizations and individuals;
(3) Names and addresses of organizations and individuals producing similar or directly competitive goods for or against the case;
(4) Description of imported goods entitled to tariff preferences under the UKVFTA Agreement that are required to be investigated for applying a safeguard measure, including scientific name, trade name, common name; ingredient; basic physical and chemical properties; primary use purpose; production process; international and Vietnamese standards and regulations; commodity codes and special preferential import tax rates according to the Special Preferential Import Tariffs for the implementation of the UKVFTA Agreement;
(5) Descriptive information about similar or directly competitive goods of the domestic industry, including scientific name, trade name, common name; ingredient; basic physical and chemical properties; primary use purpose; production process; international and Vietnamese standards and regulations;
(6) Information on the volume, quantity and value of imported goods specified in Clause (4) during the period of 03 years prior to submission of the Request for Dossier and included at least 06 months after the UKVFTA Agreement effective;
(7) Information on the volume, quantity and value of similar or directly competitive goods of the domestic industry specified at Point dd of this Clause during the period of 03 years prior to submission of the application and included at least 06 months after the entry into force of the UKVFTA Agreement. In case the domestic manufacturing industry operates for less than 3 years, the collected data is the entire operation period of the domestic manufacturing industry up to the time of submitting the request;(8) Information, data and evidence of severe damage or threat of serious damage to the domestic industry;
(9) Information, data and evidence on the causal relationship between the import of goods specified in Clause (4) and serious damage or threat of serious damage to the domestic industry;
(10) Specific requirements for the application of a safeguard measure, its duration and the extent of its application
Circular 14/2021/TT-BCT takes effect from December 15, 2021.
